By participating in any activities offered by Padel MKE LLC, I acknowledge and agree to the following terms and conditions. I understand the inherent risks associated with the activities and will not hold Padel MKE LLC, its affiliates, or employees responsible for any injuries or damages that may occur during or as a result of the activities. I release Padel MKE LLC from any liability, including financial responsibility for injuries, regardless of the cause. It is my responsibility to adhere to all safety guidelines and instructions provided by Padel MKE LLC staff.
INDEMNITY WAIVER AND RELEASE OF LIABILITY AGREEMENT Padel MKE, LLC.
This Indemnity Waiver and Release of Liability Agreement (“Agreement”) is entered into between the undersigned participant (“Participant”) and Padel MKE, LLC, a Wisconsin limited liability company (“Company”).
PLEASE READ CAREFULLY. BY SIGNING THIS AGREEMENT, YOU ARE WAIVING CERTAIN LEGAL RIGHTS.
1. Acknowledgment and Assumption of Risk
The Participant acknowledges that participation in padel and related physical activities at Padel MKE, LLC facilities involves inherent risks, including, but not limited to: physical exertion, contact with other players, use of sports equipment, slippery surfaces, uneven terrain, and risk of injury or death. The Participant knowingly and voluntarily assumes full responsibility for all such risks, both known and unknown, even if arising from the negligence of the Company or others.
2. Waiver and Release of Liability
In consideration for being allowed to participate in activities at Padel MKE LLC, the Participant, on behalf of themselves, their heirs, executors, administrators, legal representatives, and assigns, hereby waives, releases, and discharges the Company, its owners, officers, directors, managers, employees, contractors, agents, affiliates, successors, and assigns from any and all claims, demands, liabilities, causes of action, or damages of any kind, whether in law or equity, arising out of or related to any injury, illness, death, or property damage sustained by the Participant while on Company premises or participating in any Company activities.
3. Indemnification
The Participant agrees to indemnify, defend, and hold harmless the Company from and against any and all claims, damages, losses, liabilities, and expenses (including attorneys’ fees) arising from or related to:(a) the Participant’s participation in activities at the facility;(b) any breach of this Agreement by the Participant; or(c) any claim brought by a third party related to the Participant’s conduct.
4. Medical Treatment and Insurance
The Participant understands that the Company does not provide medical treatment or insurance coverage for injuries sustained during participation. The Participant is responsible for all costs of medical care and any related expenses.
5. Use of Likeness
The Participant grants the Company permission to use photographs, videos, or other recordings of the Participant taken at Company facilities for promotional, marketing, or commercial purposes without compensation.
6. Compliance with Rules
The Participant agrees to abide by all rules, policies, and instructions posted at the facility or provided by Company staff. The Company reserves the right to remove any individual for unsafe or inappropriate conduct.
7. Severability
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
8. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Wisconsin, without regard to its conflicts of law principles.
9. Entire Agreement
This document constitutes the entire agreement between the parties regarding the subject matter herein and supersedes all prior discussions, representations, or agreements.
